Simmons<\/strong>, announced <strong>500 new cases<\/strong> of immigration and related crimes filed between <strong>August 28 and September 10, 2026<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of that total, <strong>449 cases<\/strong> came from the <strong>Del Rio and El Paso<\/strong> offices. Charges include migrant smuggling, illegal reentry, and cases against defendants with prior convictions or multiple previous removals; the release describes one person charged after <strong>nine prior deportations<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ICE, the Border Patrol, the DEA, the FBI, the U.S. Marshals Service, the ATF, and state and local agencies took part, under a federal initiative called <em>Operation Take Back America<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One precision the daily-report headline rounds off: <strong>the period is not &#8220;the first two weeks of September&#8221;<\/strong> but a fourteen-day stretch beginning August 28. And, as always, <strong>una acusaci\u00f3n no equivale a una condena<\/strong>: every defendant is presumed innocent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can a U.S. citizen be charged with transporting?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes \u2014 and this announcement illustrates it: among the cases described are <strong>two U.S. citizens<\/strong> charged with transporting undocumented people for <strong>$2,000<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The governing statute is <strong>8 U.S.C. \u00a7 1324<\/strong>, which punishes transporting, moving, concealing or harboring a person <strong>knowing, or in reckless disregard of the fact<\/strong>, that they are in the country without authorization. Penalties reach <strong>5 a\u00f1os<\/strong>, and up to <strong>10<\/strong> where there was financial gain; they climb far higher if anyone is injured.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two points that matter:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Citizenship is not a defense.<\/strong> The offense punishes the conduct, not the status of whoever commits it.<\/li>\n\n\n\n<li><strong>&#8220;I didn&#8217;t know&#8221; is not always enough.<\/strong> The reckless-disregard standard allows charges against someone who ignored obvious signs, even if nobody said it outright.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This does <strong>no<\/strong> make driving a neighbor to the grocery store a crime. The statute requires knowledge or reckless disregard, and in practice the cases that get filed tend to have very concrete elements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What does a prosecutor look at?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no formula, but files that end in charges usually share several of these:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Payment or a promise of payment:<\/strong> the heaviest factor, and the one that raises the penalty.<\/li>\n\n\n\n<li><strong>Proximity to the border and the route:<\/strong> picking people up at a crossing point or on a road that skirts checkpoints.<\/li>\n\n\n\n<li><strong>Concealment:<\/strong> people in a trunk, plates that do not match the vehicle, fleeing from authorities.<\/li>\n\n\n\n<li><strong>Number of passengers and conditions:<\/strong> large groups or circumstances that endanger life.<\/li>\n\n\n\n<li><strong>Prior coordination:<\/strong> messages, calls or instructions showing an arrangement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">None of this is decided by reading an article: every case turns on very specific facts and requires an attorney reviewing the actual evidence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What should you do if you are stopped on the road?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Stay calm and keep your hands visible:<\/strong> do not argue, do not run, do not speed away.
