Associate Attorney General Stanley E. Woodward Jr. said: <em>&#8220;No more placing illegal aliens over American citizens on this Department of Justice&#8217;s watch.&#8221;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The federal argument rests on <strong>8 U.S.C. \u00a7 1623<\/strong>, section 505 of the 1996 law, which bars giving a person without lawful presence an education benefit <strong>based on residence<\/strong> unless the same benefit is available to any U.S. citizen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does anything change today for Utah students?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not automatically \u2014 and this is the most important part of the article.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lawsuit is a <strong>request<\/strong> to a court, not a decision. The federal government is asking a judge to <strong>enjoin enforcement<\/strong> of Utah&#8217;s law. Until a court order exists, the state law <strong>remains in effect<\/strong> and universities continue to apply it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Utah System of Higher Education responded that it supports students who meet the eligibility requirements set in state law and defers to the Legislature&#8217;s authority over tuition policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What is fair to assume is that <strong>the timeline is uncertain<\/strong>. In other states these cases have resolved within months, sometimes by agreement between the federal government and the state, without a trial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How have these cases ended elsewhere?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not all the same way, and that nuance gets lost in headlines.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kentucky and Kansas:<\/strong> the states accepted consent decrees withdrawing the benefit, in March and September 2026.<\/li>\n\n\n\n<li><strong>Illinois:<\/strong> a federal court held the in-state tuition provisions unconstitutional in July 2026.<\/li>\n\n\n\n<li><strong>Oklahoma:<\/strong> a court order limited access to students meeting a lawful-presence definition.<\/li>\n\n\n\n<li><strong>Minnesota:<\/strong> the court <strong>dismissed<\/strong> the federal challenge, finding that eligibility tied to attending a state high school is not a benefit &#8220;based on residence.&#8221;<\/li>\n\n\n\n<li><strong>Texas:<\/strong> the Fifth Circuit affirmed that students seeking to intervene to defend the law lacked standing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The practical lesson runs two ways: the outcome <strong>depends on how each state law is written<\/strong>, and on whether the state chooses to defend it or settle.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What should you do this semester?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Confirm your tuition classification in writing:<\/strong> ask admissions or the registrar and keep the dated communication. If anything changes, that document is your starting point.<\/li>\n\n\n\n<li><strong>Keep your full education file:<\/strong> your Utah high school diploma or certificate, transcripts, and any affidavit you signed under state law.<\/li>\n\n\n\n<li><strong>Ask about private and institutional scholarships:<\/strong> these do not depend on immigration status or on this lawsuit, and many universities have their own funds.<\/li>\n\n\n\n<li><strong>Do not drop the semester out of fear:<\/strong> withdrawing early can cost you credits and aid you currently hold.<\/li>\n\n\n\n<li><strong>Be wary of anyone offering to &#8220;fix&#8221; your status quickly:<\/strong> no immigration filing is created or lost because of this lawsuit.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In-state tuition is a state education benefit, not an immigration status. Whether the case advances or not, it <strong>grants and takes away<\/strong> no visas, work permits or protection from deportation.
